Terms of Service
Last updated: October 15, 2026
These Terms of Service ("Terms") are an agreement between you and Bike Monkey, Inc. ("Bike Monkey, Inc.", "Plantains", "we", "us" or "our"), the company that operates Plantains, an online service for building registration forms, taking registrations and collecting payments for events (the "Service"), at plantains.app.
Please read these Terms carefully. Section 17 requires most disputes to be resolved by individual binding arbitration and waives class actions and jury trials. Section 6 explains that paid plans renew automatically until you cancel.
1. Who these Terms apply to
These Terms apply to everyone who creates or uses a Plantains account: the person who signs up and owns an account ("Owner"), and every teammate invited to it. An "account" is one organization's workspace in Plantains. "You" means you personally and, when you use the Service for a business, club, nonprofit or other organization, that organization too ("Customer"). People who only fill in a form to register for an event are covered by our Registrant Terms, not these Terms.
By checking the box to accept these Terms, or by using the Service, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy, which are part of these Terms. If you accept on behalf of an organization, you confirm that you have authority to bind it. If you don't agree, don't use the Service.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- Give us accurate information and keep it up to date, including a working email address.
- Keep your sign-in credentials secure. You're responsible for everything done through your account, including by teammates you invite, and for the roles and access you give them. Tell us right away at legal@plantains.app if you think your account has been compromised.
- Each person may belong to one account. We may refuse, suspend or close accounts that break these Terms.
3. The Service
Plantains lets you build forms, publish them, take registrations, collect payments through your own Stripe account, collect electronic waiver signatures, send emails to registrants, check people in, and export your data. We keep improving the Service, so features may change. We may add, change or remove features, and we'll give reasonable notice before removing something material that you pay for.
We don't promise the Service will be uninterrupted or error-free. We may need to take it down for maintenance, and things outside our control (hosting, payment, email and other providers, the internet) can fail. Keep your own copies of anything you can't afford to lose: you can export registrations at any time.
4. Your events and your responsibilities
You are the organizer of your events; we are not. We provide software. We don't organize, run, insure, supervise, promote or endorse any event, and we aren't a party to any agreement between you and your registrants. You alone are responsible for:
- Your events: their safety, staffing, permits, insurance, rules, cancellations, changes and everything that happens at them.
- What your forms say and ask, including prices, descriptions, eligibility rules and policies.
- Your refund, transfer and cancellation policies, honoring them, and handling refunds, disputes and chargebacks.
- The content and enforceability of your waivers and releases. Plantains records electronic signatures, but we don't provide legal advice and don't promise that any waiver, release or consent will be valid or enforceable. Have yours reviewed by your own lawyer or insurer.
- Complying with every law that applies to you and your events, including consumer protection, privacy, data security, anti-spam, accessibility, tax, sales, charitable solicitation and raffle or sweepstakes laws.
- Having a lawful basis and any required consent to collect and use registrants' information, telling registrants how you use it (your own privacy notice where required), and only collecting what you need.
- Registrations of minors: making sure a parent or legal guardian provides the information and consents your event requires.
- Any service fee you choose to pass on to registrants: showing it clearly and making sure passing it on is lawful where you operate.
5. Payments to you (Stripe)
Registrants' card payments are processed by Stripe, Inc. ("Stripe") through a Stripe account you connect to Plantains. Plantains is not a bank, payment processor or money transmitter, and never holds your funds. Payments go to your Stripe account under your agreements with Stripe, including the Stripe Connected Account Agreement and Stripe Services Agreement. You are the merchant of record for your registrants' payments. You're responsible for Stripe's processing fees, refunds, disputes, chargebacks, reversals and any related fees and losses, and for complying with Stripe's terms. Stripe, not Plantains, decides whether to approve your Stripe account and may restrict or close it.
By connecting Stripe, you authorize Plantains to create charges, refunds and related transactions on your Stripe account as you direct through the Service, and to collect our Platform Fees (Section 6) from those payments as application fees.
6. Plans, fees and automatic renewal
Current plans and prices are shown on the Billing page in your account and on our website, and are part of these Terms.
- Free trial. New accounts start with a free trial of the length shown when you sign up (currently 90 days). A payment card is required to start it. There's no subscription charge during the trial, but Platform Fees on card payments apply.
- Automatic renewal. When the trial ends, your account automatically becomes a paid subscription (currently the Basic plan at $25 per month, or $250 per year if you chose yearly billing), and we charge your card at the start of each billing period until you cancel. We'll remind you by email before the trial ends.
- Usage charges. Your subscription includes a number of published forms that are open for registration (currently 15). Each additional open form is charged at the price shown on your Billing page (currently $2.50 per month or $25 per year), prorated as forms open and close. Registrations that don't go through a card payment are included up to a monthly number per account (currently 250 a month); beyond that, each is charged a per-registration fee (currently $0.01), billed monthly in arrears, outside the trial. Closed and unpublished forms are free.
- Platform Fees. On card payments made through your forms, we collect a fee of the percentage and fixed amount for your plan (currently 3% + $0.50 per registration during the trial and 1% + $0.25 on Basic). The percentage applies to every payment, the fixed amount once per registration. Platform Fees are deducted from each payment through Stripe. Payments you record by hand (cash, checks) carry no Platform Fee.
- Refunds of registrations. When you refund a registrant, Platform Fees already collected on that payment are not returned, and neither are Stripe's fees, unless Stripe decides otherwise.
- How to cancel. You can cancel at any time from the Billing page in your account (Manage billing), with no need to contact us. Cancellation takes effect at the end of the current billing period; you keep access until then. If you cancel during the trial, you won't be charged a subscription fee.
- No refunds of subscription fees. Subscription and usage charges are non-refundable, including for partial periods, unused forms or downgrades, except where the law requires otherwise.
- Price changes. We may change our prices. We'll tell you at least 30 days before a change to your subscription price takes effect; it applies from your next billing period after that. If you don't agree, cancel before then.
- Failed payments. If we can't charge your card, we'll retry and let you know. Until it's paid, we may limit your account (for example, prevent creating new forms), and after a reasonable period we may suspend or close it.
- Taxes. Prices don't include taxes. You're responsible for any sales, use, VAT or similar taxes on our fees (other than taxes on our income), and for taxes on your own sales to registrants.
- Complimentary accounts. We may give some accounts free or discounted use at our discretion, and may end that by giving notice.
7. Your data
"Customer Data" means the forms you build and the information you and your registrants submit through them, including registrations, answers, signatures and files.
- You own your Customer Data. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display it only as needed to provide, secure and support the Service, to comply with law, and as described in our Privacy Policy.
- Our role. For registrant information collected through your forms, we act as your service provider (or "processor"): we process it on your behalf and under your instructions, and we don't sell it or use it for advertising. You're responsible for your relationship with your registrants and for responding to their requests about their information; we'll help with reasonable requests.
- Export and deletion. You can export your registrations while your account is open. After your account is closed, we may delete Customer Data after 90 days, except copies we must keep by law or that remain in backups for a limited time.
- Sensitive information. Don't use Plantains to collect payment card numbers (outside Stripe's payment fields), Social Security or other government ID numbers, bank account numbers, passwords, or health information beyond what your event reasonably needs (such as emergency contact details or allergies). Plantains isn't designed for regulated data such as protected health information under HIPAA.
- Aggregated data. We may use de-identified, aggregated information about use of the Service (which doesn't identify you or any registrant) to operate and improve the Service.
8. Acceptable use
You must follow our Acceptable Use Policy. You're responsible for the content of your forms and for what your teammates do in your account.
9. Emails sent through Plantains
Plantains sends emails to registrants for you, such as confirmations, receipts, waiver requests and payment requests. These are transactional messages about a registration. Don't use Plantains to send marketing or promotional email unless the law allows it and the recipient has agreed. We may limit or stop emails that cause complaints or bounces, or that harm our sending reputation.
10. Third-party services
The Service relies on and links to services run by others, such as Stripe (payments), Clerk (sign-in), Google (sign-in with Google), and our hosting, database and email providers. Your use of those services is governed by their own terms, and we aren't responsible for them.
11. Our intellectual property and feedback
We own the Service, including its software, design, logo and the name Plantains. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms while your account is in good standing. Don't copy, modify, resell or reverse engineer the Service except as the law allows. If you send us ideas or feedback, we may use them without obligation to you.
12. Copyright complaints
If you believe content on Plantains infringes your copyright, send a notice to our designated agent with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)). We'll respond to valid notices, which may include removing the content and terminating repeat infringers.
Our designated agent for notices of claimed infringement:
- Name: Carlos Perez, Copyright Agent
- Mail: Bike Monkey, Inc. (Plantains), PO Box 5318, Santa Rosa, CA 95402
- Phone: (707) 800-3020
- Email: dmca@plantains.app
13. Suspension and termination
- You can stop using the Service and cancel at any time (Section 6).
- We may suspend or close your account, or take down a form, right away if you break these Terms or the Acceptable Use Policy, if your use creates risk or possible legal exposure for us, Stripe, registrants or others, if required by law, or if you don't pay. Where reasonable, we'll tell you first and give you a chance to fix the problem.
- We may end the Service entirely with at least 60 days' notice, and refund any prepaid subscription fees for the unused period.
- Sections that by their nature should survive ending (including 4, 5, 6 for amounts owed, 7, 11, 14 to 18) survive.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We don't warrant that the Service will be uninterrupted, secure or error-free, that data won't be lost, or that any form, price calculation, waiver or report will meet your needs or legal requirements. Check your forms, prices and settings before publishing them. Some places don't allow these disclaimers, so some may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW:
- NEITHER Bike Monkey, Inc. NOR ITS OWNERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, REGISTRATIONS, GOODWILL OR DATA, EVEN IF TOLD THEY WERE POSSIBLE.
- WE ARE NOT LIABLE FOR ANY INJURY, ILLNESS, DEATH, PROPERTY DAMAGE OR OTHER LOSS ARISING FROM ANY EVENT, OR FROM YOUR RELATIONSHIP WITH YOUR REGISTRANTS.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US (SUBSCRIPTION FEES, USAGE CHARGES AND PLATFORM FEES) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
These limits apply whatever the legal theory, and even if a remedy fails of its essential purpose. They don't limit liability that the law doesn't allow to be limited.
16. Indemnification
You will defend, indemnify and hold harmless Bike Monkey, Inc. and its owners, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your events, including any injury, illness, death or property damage at or connected with them; (b) your forms, Customer Data, waivers, policies and communications; (c) your dealings with registrants, including payments, refunds, disputes and chargebacks; (d) your breach of these Terms or of law; or (e) the acts of your teammates. We'll tell you about a claim promptly and let you control its defense, but you may not settle a claim that admits fault by us or obliges us to do anything without our written consent.
17. Disputes: arbitration and class-action waiver
Talk to us first. Before starting a formal dispute, email legal@plantains.app with a description of it, and give us 30 days to try to resolve it informally.
Binding arbitration. If we can't resolve it, you and Bike Monkey, Inc. agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules (or, if you're using the Service as an individual consumer, its Consumer Arbitration Rules), before a single arbitrator. The arbitration will take place in California or by video, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may ask a court for an injunction to protect its intellectual property or to stop unauthorized use of the Service.
Class-action and jury waiver. YOU AND Bike Monkey, Inc. EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING, AND EACH WAIVES THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of more than one person. If this class-action waiver is found unenforceable for a claim, that claim must be decided in court, not in arbitration.
Opting out. You can opt out of this arbitration agreement by emailing legal@plantains.app within 30 days of first accepting these Terms, with your name, your account's name and a statement that you opt out of arbitration. Opting out doesn't affect the rest of these Terms.
18. Governing law and venue
These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-laws rules. For any Dispute not subject to arbitration, you and Bike Monkey, Inc. consent to the exclusive jurisdiction of the state and federal courts located in California.
19. Changes to these Terms
We may update these Terms. If a change is material, we'll tell you by email or in the Service before it takes effect and ask you to accept the updated Terms to keep using the Service. Other changes take effect when posted. The date at the top shows when they last changed.
20. General
- Entire agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy and the plan and prices shown in your account, are the whole agreement between you and us about the Service.
- Notices. We'll send notices to your account's email address or show them in the Service. Send notices to us at legal@plantains.app.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them in a merger, acquisition or sale of assets, or to an affiliate.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control (other than your obligation to pay).
- Severability and waiver. If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver of it.
- Independent parties. You and we are independent contractors; these Terms create no partnership, agency or employment relationship.
- Electronic communications. You agree to receive notices and agreements electronically, and that your electronic acceptance is as binding as a signature.
